2.1 Digital Products
- Downloadable English learning ebooks in PDF format, sold individually or as bundled collections, available for purchase by customers in India and internationally.
2.2 Online Educational Services
- One-on-one online English Communication tutoring
- Online Spoken English group classes
- Online English Honours, Masters coaching (subject-specific university-level English literature/language instruction)
- Online subject-English tuition (school-level English subject tutoring)
2.3 Offline Educational Services
- Home tuition, conducted at the student’s residence, within serviceable areas as communicated at the time of enrollment
- In-person group coaching classes conducted at our physical coaching centers
References to “Services” throughout these Terms include all categories above, unless a specific section states otherwise.
3. Eligibility and Account Responsibility
3.1 By using this Website or enrolling in any Service, you confirm that you are at least 18 years of age, or are enrolling with the involvement and consent of a parent or legal guardian if you are a minor.
3.2 Where a Student is a minor, all references to “you” in the context of payment, agreement to Terms, and communication shall be understood to mean the parent or legal guardian acting on the minor’s behalf.
3.3 You are responsible for maintaining accurate contact information (email address, phone number, address where relevant) to ensure smooth delivery of digital products and coordination of educational services.
4. Purchases, Pricing, and Payment
4.1 Currency and Pricing: Prices for digital ebooks are listed in Indian Rupees (₹) for customers based in India, and in US Dollars ($) for customers based outside India. Pricing for online and offline courses/tuition will be communicated directly at the time of enrollment and may vary based on course type, duration, format (one-on-one vs. group), and location.
4.2 Payment Processing: All online payments are processed securely through Razorpay, a third-party payment gateway. Englishpick does not store your card, UPI, or banking credentials directly; these are handled by Razorpay in accordance with its own security and privacy standards.
4.3 Payment for Offline Services: Fees for home tuition and coaching center classes may be collected online (via Razorpay payment links) or through other mutually agreed methods communicated at enrollment.
4.4 Confirmation of Purchase: For digital products, a successful transaction will trigger automatic email delivery of the purchased ebook(s). For courses and tuition, a successful payment confirms your seat/slot subject to the specific enrollment terms communicated for that course.
5. Digital Product Delivery and License
5.1 Instant Delivery: Ebooks are delivered electronically as downloadable PDF files immediately upon successful payment confirmation. It is your responsibility to provide a valid, active email address to receive your purchase and download link.
5.2 Limited License: Purchase of an ebook grants you a personal, non-exclusive, non-transferable license to use the ebook for your own individual learning purposes only.
5.3 Prohibited Use: You may not copy, reproduce, resell, redistribute, publicly share, upload to file-sharing platforms, or otherwise commercially exploit any ebook or its contents, in whole or in part, without our prior written consent. Doing so constitutes a violation of these Terms and applicable copyright law, and may result in legal action.
5.4 Technical Requirements: You are responsible for ensuring you have appropriate software (a PDF reader) and a device capable of opening and viewing the delivered file.
6. Online Educational Services — Additional Terms
6.1 Scheduling: Session timings for one-on-one and group online classes will be mutually agreed upon at enrollment. Punctuality and consistent attendance are expected for both parties.
6.2 Platform: Online sessions may be conducted via video conferencing platforms (such as Zoom, Google Meet, or similar) as communicated by us. You are responsible for ensuring you have a stable internet connection and compatible device.
6.3 Course Materials: Any supplementary materials provided during online courses (worksheets, presentations, recordings) are for your personal educational use only and are subject to the same usage restrictions outlined in Section 5.3.
6.4 English Honours and Subject-English Tuition: These services are tailored to academic curricula as communicated at the time of enrollment. While we aim to provide comprehensive support, we do not guarantee specific academic outcomes, grades, or examination results, as these depend on multiple factors including the student’s own effort and preparation.
7. Offline Educational Services — Additional Terms
7.1 Home Tuition:
- Home tuition sessions are conducted at the address provided by the student/guardian at the time of enrollment, within our serviceable areas.
- The student/guardian is responsible for providing a safe, quiet, and appropriate learning environment for the duration of the session.
- Any change of address must be communicated in advance, and continued service is subject to the new location falling within our serviceable range.
7.2 Coaching Center Classes:
- In-person group classes are conducted at our designated coaching center locations, as communicated at the time of enrollment.
- Students are expected to adhere to attendance, punctuality, and conduct expectations communicated separately for each batch/center.
- We reserve the right to make reasonable changes to class timing, batch composition, or location due to operational necessity, with advance notice provided where possible.
7.3 Safety and Conduct: Both home tuition and coaching center sessions are expected to be conducted in a respectful, safe environment. We reserve the right to discontinue service to any student or at any location where safety concerns, misconduct, or repeated non-cooperation arise.
8. Intellectual Property
All content created by Englishpick — including but not limited to ebook text and design, course materials, teaching methodology, website content, and branding — is the intellectual property of Sujoy/Englishpick and is protected under applicable copyright and intellectual property laws. Nothing in these Terms transfers ownership of any such intellectual property to you.
9. Limitation of Liability
9.1 Englishpick provides educational products and services on an “as-is” basis. While we strive for accuracy, quality, and consistency in our ebooks and teaching, we do not guarantee specific learning outcomes, examination results, or fluency milestones, as these depend significantly on individual student effort and circumstances beyond our control.
9.2 To the maximum extent permitted by applicable law, Englishpick shall not be liable for any indirect, incidental, or consequential damages arising from the use of our digital products, online services, or offline services.
9.3 Nothing in these Terms limits liability for matters that cannot be excluded under Indian law, including liability arising from gross negligence or willful misconduct.
10. Termination of Service
We reserve the right to suspend or discontinue service to any customer or student who violates these Terms, engages in abusive or unsafe conduct, or fails to make agreed payments, with reasonable notice provided where practicable.
11. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Kolkata, West Bengal.
